1. About these Terms and acceptance
These Terms of Service (the Terms) are a legal agreement between you and (to be added), with its registered office at (to be added) (RiseDare, we, us, our). They govern your use of the RiseDare apps for iOS and Android, the companion apps for Apple Watch and Wear OS, the website risedare.com, and any related features, content and support (together, the Service).
These Terms are an electronic record under the Information Technology Act 2000 and the rules made under it, and are published in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 and the Consumer Protection (E-Commerce) Rules 2020. They do not need a physical or digital signature.
Please read them carefully. They include important information about alarms not being guaranteed, about health and safety, about charges under Hardcore Mode, and about the limits of our liability.
By creating an account, starting a free trial, buying a plan or otherwise using RiseDare, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not use the Service.
If you use the Service on behalf of someone else, such as a child in your care or the members of a Family plan you organise, you confirm that you are allowed to accept these Terms for them.
2. Other documents that form part of these Terms
The following policies are part of these Terms. Where one of them deals with a subject in more detail, that policy applies to that subject.
- Subscription and Auto-Renewal Terms: plans, prices, free trials, renewals and cancellation.
- Refund and Cancellation Policy and Service Delivery Policy.
- Hardcore Mode Terms: stakes, donations, grace passes, limits and appeals.
- Rewards and Referral Terms.
- Chuzi AI Terms.
- Community Guidelines.
- Health and Wellness Disclaimer.
- Privacy Policy, Cookie Policy, Children's Privacy, App Permissions and Data Safety, and Data and Account Deletion, which explain how we handle personal data.
- Grievance Redressal and Contact.
3. Eligibility
You must be at least 13 years old, or the minimum age required in your country if that is higher, to use RiseDare. If you are under 18, you may use RiseDare only with the consent of a parent or guardian, who accepts these Terms on your behalf and is responsible for your use of the Service.
Hardcore Mode is only for users aged 18 or over. Paid rewards are also disabled for users under 18.
You may not use the Service if you are barred from doing so under the laws of India or of the country where you live, or if we have previously suspended or removed your account for breaking these Terms.
4. Your account
You need an account for most features. Give us accurate information when you sign up and keep it up to date, in particular your email address or phone number, because we use it for sign-in, receipts and important notices.
Keep your login secure and do not share it. You are responsible for activity on your account. Tell us at [email protected] as soon as you suspect unauthorised access.
An account is personal to you. You may not sell or transfer it. One person may not hold several accounts in order to obtain repeated free trials, referral rewards or other benefits.
5. What RiseDare provides
RiseDare is an alarm clock that keeps ringing until you complete a real-world mission, which we call a dare. Missions include photo missions such as the sky photo and make-your-bed, exercise missions such as push-ups and squats counted by on-device pose detection, mental missions such as maths, memory games and typing a phrase, spoken missions such as an affirmation or verse, and others such as scanning a QR code, shaking the phone or walking a number of steps. A backup mission is available if you cannot do the one that was set.
Around the alarm, the Service offers optional features including sleep tracking, groups with a live board, nudges and leaderboards, the Chuzi AI coach, Hardcore Mode, streaks and badges, and referral and streak rewards. Some features are available only on a paid plan.
We improve the Service continuously. We may add, change or remove features, missions, supported languages and supported devices. If we remove a feature that is a significant part of a plan you have paid for, we will tell you in advance where reasonably possible and you will have the rights set out in the Refund and Cancellation Policy and under consumer law.
6. Alarm reliability: please read
We work hard to make alarms reliable, but an alarm on a phone depends on things we do not control: your device and its manufacturer's software, operating system settings and updates, notification and exact-alarm permissions, battery optimisation and background restrictions, Do Not Disturb and focus settings, volume and audio routing, storage, and the phone being switched on and charged.
For alarms to work as intended, you need to grant the permissions the app asks for during setup, follow the device-specific setup guide where one is shown, keep the app updated, and keep your phone charged and switched on.
RiseDare must not be your only alarm for critical events such as flights, exams, interviews, medication, or safety-critical work. Use a second, independent alarm for anything you cannot afford to miss. We do not promise that an alarm will ring in every case, and our responsibility for a missed alarm is limited as set out in the Liability section.
7. Licence to use the apps
Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the RiseDare apps on devices you own or control, and to use the website, for your own non-commercial use. On Apple devices the licence is also subject to the usage rules in the App Store terms; on Android devices, to the Google Play terms.
We and our licensors keep all rights that are not expressly given to you. The app may include open-source components, which are licensed to you under their own licences.
8. Acceptable use
You agree to use the Service lawfully and with respect for others. In particular, you must not:
- Misuse the Service, reverse engineer, decompile or tamper with the apps, or get around paid features, mission checks, Hardcore Mode or other technical limits, except to the extent the law expressly allows.
- Harass, bully, threaten or impersonate anyone, or post hateful, sexually explicit, violent, defamatory or unlawful content in groups, names, avatars, custom dares or Chuzi chats.
- Post or share anything that infringes someone else's intellectual property, privacy or other rights, including other people's photos or personal details without their consent.
- Do missions in unsafe places or situations, such as on roads, at heights, near water, or while driving or operating machinery.
- Use bots, scripts, fake accounts or other automated means to use the Service, collect data from it, or obtain trials, referral rewards or other benefits you are not entitled to.
- Interfere with or disrupt the Service, its servers or its security, or introduce malware.
- Use the Service to harm minors, to send spam or scams, or for any purpose prohibited by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021 or other applicable law.
- Use the Service commercially, or resell or sublicense it, without our written permission.
9. Groups and community
Groups let you wake up alongside friends, see a live board, send nudges and reactions and compete on leaderboards. When you join a group, its members can see your name, avatar and wake-up status and whatever you post.
Our Community Guidelines apply to everything you do in groups. You can report a message or a member from inside the app. We review reports within 24 hours and may remove content, restrict features or suspend accounts.
We do not review all content before it is posted and are not responsible for what users post. To the extent we act as an intermediary under Indian law, we follow the due diligence and grievance requirements that apply to intermediaries.
10. Your content
You keep ownership of the content you create or share through the Service, such as custom alarm sounds, custom dares, group names, messages and any photos you choose to share.
You give us a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and play that content only as needed to provide the Service to you and to the people you share it with. The licence ends when you delete the content or your account, apart from copies we are required by law to keep and copies others have already saved.
You confirm that you have the rights needed to share your content and that it does not break these Terms. If you send us feedback or suggestions, we may use them freely without any obligation to you.
11. Chuzi AI and third-party services
Chuzi is an AI coach that produces morning briefings, coaching replies, custom dares, sleep stories, a wake-up voice and group roasts and hype messages using third-party language models. AI output can be wrong, incomplete or out of date. Do not rely on Chuzi for medical, legal or financial decisions.
Your use of Chuzi is governed by the Chuzi AI Terms, and what happens to the text you send is explained in the Privacy Policy.
The Service relies on or connects to services run by others, including app stores, payment gateways, banks and UPI apps, Apple Health and Health Connect, AI providers, reward partners and donation partners. Their own terms apply to your use of them. We are not responsible for services we do not control, although we will help where we reasonably can.
12. Plans, free trials and payment
RiseDare offers a Free plan and paid plans: Pro Monthly, Pro Yearly, Lifetime and Family, which covers up to 6 members. Eligible new users get a 3-day free trial. Current prices are shown on the pricing page and in the app before you buy; they include applicable GST and may differ by country and store.
You can buy through the Apple App Store, Google Play or our website. Website purchases are processed by a payment gateway and can be paid by UPI, UPI AutoPay, cards or net banking. Store purchases are also subject to the terms of Apple or Google, who process the payment.
Recurring plans renew automatically until you cancel. Cancelling stops future renewals and you keep your paid features until the end of the period you have paid for. Deleting the app or your account does not by itself cancel a subscription bought through a store.
The details, including how trials convert, how to cancel on each platform, pre-debit notifications for mandates, price changes and refunds, are set out in the Subscription and Auto-Renewal Terms, the Refund and Cancellation Policy and the Service Delivery Policy.
13. Hardcore Mode
Hardcore Mode is an optional commitment feature for adult Pro subscribers. You choose an amount between ₹10 and ₹1,000 that is charged when you miss an alarm with Hardcore Mode on. You choose whether that money is kept by RiseDare or donated to a cause from our list. You get 1 free grace pass each calendar month, and you can appeal a charge.
Hardcore Mode is a self-commitment tool. It is not gambling, betting or a game of chance, and there is no prize or winnings. By turning it on you authorise the charges described in the Hardcore Mode Terms, which set out exactly what counts as a miss, the weekly limit, grace passes, how appeals work and how to turn the feature off. Please read them before you switch it on.
14. Rewards and referrals
Streaks, badges and the growth of your Chuzi mascot are features of the app and have no monetary value. Streak rewards, partner coupons, referral benefits and any wallet credits are governed by the Rewards and Referral Terms. Unless those terms say otherwise, rewards have no cash value, cannot be transferred and may change or end. Partners are responsible for fulfilling their own offers.
We may withhold or reverse rewards obtained through self-referrals, fake accounts or other abuse.
15. Health and safety
Fitness missions, sleep scores and insights, and Chuzi's tips are for general wellbeing. They are not medical advice, and RiseDare is not a medical device. Do fitness missions only if you are physically able to, stop any mission that causes pain, dizziness or discomfort, and use the backup mission if you are injured, pregnant or have been advised not to exercise. Consult a doctor about sleep disorders or any health concern.
You are responsible for choosing missions that are safe for you and for where and how you do them. See the Health and Wellness Disclaimer for more.
16. Intellectual property
RiseDare, Chuzi, the logos, the mascot artwork, the app's design, text, sounds, software and other content belong to us or our licensors and are protected by copyright, trade mark and other laws. These Terms do not give you any right to use our names, logos or other brand features without our written permission.
If you believe content on the Service infringes your rights, write to our Grievance Officer at [email protected] with enough detail for us to identify the content and verify your claim.
17. Additional terms for apps downloaded from the App Store
If you downloaded the app from the Apple App Store, the following also applies.
- These Terms are between you and RiseDare, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any, of the app. To the maximum extent permitted by law, Apple has no other warranty obligation in respect of the app.
- Apple is not responsible for addressing any claims relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation.
- If a third party claims that the app infringes its intellectual property rights, RiseDare, not Apple, is responsible for investigating, defending, settling and discharging the claim.
- You confirm that you are not located in a country subject to a government embargo, or designated as a terrorist-supporting country, and that you are not on any government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as a third-party beneficiary.
18. Suspension and termination
You can stop using RiseDare and delete your account at any time, in the app at Settings → Account → Delete account or through the website. See Data and Account Deletion for what is deleted and what we must keep.
We may suspend or end your access, or remove content, if you break these Terms or the Community Guidelines, if we are required to by law, or if your use creates risk for other users or for RiseDare. We will give notice where reasonable, and you can challenge our decision through the Grievance Redressal process.
When your account ends, your licence to use the Service ends. Sections that by their nature should continue, such as those on intellectual property, liability, indemnity and governing law, continue to apply. Ending your account does not cancel amounts already properly charged, and does not remove any refund right you have under the Refund and Cancellation Policy or the law.
19. Disclaimers and events outside our control
We provide the Service with reasonable care and skill. Beyond that, and to the extent permitted by law, the Service is provided as it is and as available. We do not promise that it will be uninterrupted, error-free or suited to a particular purpose, that an alarm will ring in every situation, that mission checks, sleep estimates or AI output will always be accurate, or that using RiseDare will produce any particular result.
Nothing in these Terms takes away rights you have as a consumer that cannot be excluded by agreement, including under the Consumer Protection Act 2019.
We are not responsible for failure or delay caused by events beyond our reasonable control, such as outages of networks, app stores, payment systems or cloud providers, operating system changes, natural events, or actions of government.
20. Liability
To the extent permitted by law, RiseDare is not liable for indirect or consequential losses, including missed appointments, travel, exams, work or opportunities due to a failed alarm, loss of data, or loss of profit or goodwill.
To the extent permitted by law, our total liability to you for all claims relating to the Service is limited to the amount you paid us in the 12 months before the claim.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence, and nothing limits your statutory rights as a consumer.
21. Your responsibility to us
If your breach of these Terms, your content or your misuse of the Service leads to a claim against us by someone else, you agree to compensate us for the reasonable losses and costs that result, to the extent permitted by law. This does not apply to the extent the claim was caused by our own fault.
22. Complaints and grievance redressal
If something goes wrong, contact [email protected] first; most problems are solved quickest this way. If you are not satisfied, you can write to our Grievance Officer, (to be added), at [email protected]. We acknowledge complaints within 24 hours and resolve them within 15 days, or within 72 hours for content-removal requests concerning you.
If you are still not satisfied, you may approach the National Consumer Helpline (1915), the appropriate consumer commission, or, for matters about personal data, the Data Protection Board of India. The full process is on the Grievance Redressal and Contact page.
23. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to the next sentence, the courts with jurisdiction over the place of our registered office have exclusive jurisdiction over disputes relating to these Terms or the Service. This does not affect your right as a consumer to bring a claim before a consumer commission that has jurisdiction, or any mandatory consumer rights you have in your country of residence.
24. Changes to these Terms
We may change these Terms as the Service or the law changes. We will notify you in the app or by email at least 15 days before material changes take effect. If you do not agree with a change you can stop using the Service and cancel your plan before it takes effect; continuing to use the Service after that date means you accept the updated Terms.
We will also remind users of these Terms and our policies periodically, as required of intermediaries under Indian law.
25. General
- Entire agreement: these Terms and the policies listed above are the whole agreement between you and us about the Service.
- Severability: if a court finds part of these Terms unenforceable, the rest continues to apply.
- No waiver: if we do not enforce a right at once, we may still enforce it later.
- Transfer: you may not transfer your rights under these Terms. We may transfer ours to a successor of our business, and your rights will not be reduced as a result.
- Language: these Terms are written in English and may be made available in other languages for convenience. If versions differ, the English version prevails to the extent permitted by law.
- Notices: we may send notices in the app, by email or by posting on the website. Send legal notices to us at our registered office or to [email protected].
